<p><span style='font-size:10pt'><span style='font-size:12.0pt'>NOTICE OF A JOINT PUBLIC HEARING of the Franchise and Concession Review Committee and the New York City Department of Parks & Recreation (Parks) to be held on 9/14/2026, at 255 Greenwich Street, 8<sup>th</sup> Floor, in Manhattan, New York, NY 10007 commencing at 2:30 p.m. relative to:</span></span></p><p style='text-align:justify'><span style='font-size:12pt'>INTENT TO ENTER INTO an amendment to a License Agreement (License) with The Battery Conservancy, Inc. (Licensee) for the operation and maintenance of The Battery in Manhattan including the operation and maintenance of two (2) food service kiosks within the Bosque Gardens in the Battery, Manhattan.</span></p><p><span style='font-size:10pt'><span style='font-size:12.0pt'>The License will continue to provide for one (1) ten (10)-year term with two (2) five (5)-year renewal options.</span></span></p><p><span style='font-size:10pt'><span style='font-size:12.0pt'>Compensation to the City will be as follows: Under this Amendment, Licensee shall be entitled to 100% of the concession fees generated from the operation of the Bosque Kiosk concession to help offset Licensees costs in providing for the operation and maintenance of the Battery.</span></span></p><p><span style='font-size:10pt'><span style='font-size:12.0pt'><span style='color:black'>Written testimony may be submitted in advance of the hearing electronically to </span>[email protected]<span style='color:black'>. All written testimony can be submitted up until the close of the public hearing and will be distributed to the FCRC after the hearing.</span></span></span></p><p><span style='font-size:10pt'><span style='font-size:12.0pt'>A draft copy of the agreement may be obtained at no cost by any (or all) of the<br>following ways:</span></span></p><ol> <li><span style='font-size:10pt'><span style='font-size:12.0pt'>Submit a written request to NYC Parks at [email protected] from 8/28/2026 through 9/14/2026.</span></span></li> <li><span style='font-size:10pt'><span style='font-size:12.0pt'>Submit a written request by mail to </span><span style='font-size:12.0pt'><span style='color:black'>NYC Parks, Revenue Division, 830 Fifth Avenue, Room 407, New York, NY 10065</span></span><span style='font-size:12.0pt'>.
