<p><span style='font-size:11pt'><span style='font-family:Calibri,sans-serif'><span style='font-size:12.0pt'>NOTICE OF A JOINT PUBLIC HEARING of the Franchise and Concession Review Committee and Department of Transportation (DOT) to be held on 10/13/2026, at 255 Greenwich Street, 8<sup>th</sup> Floor, New York, NY 10007 commencing at 2:30pm relative to:</span></span></span></p><p><span style='font-size:11pt'><span style='font-family:Calibri,sans-serif'><span style='font-size:12.0pt'>INTENT TO AWARD as a concession a License Agreement (License) to Summerville Enterprises, Inc. (Concessionaire) for the development, operation, and maintenance of a food, beverage, and/or merchandise concession at Café Building and Kiosk 2, Fordham Plaza, the Bronx. </span></span></span></p><p><span style='font-size:11pt'><span style='font-family:Calibri,sans-serif'><span style='font-size:12.0pt'>The License provides for one (1) ten (10)-year term, commencing upon written Notice to Proceed, which may be renewed for up to two (2) additional five (5)-year terms, exercisable at the sole discretion of DOT. </span></span></span></p><p><span style='font-size:11pt'><span style='font-family:Calibri,sans-serif'><span style='font-size:12.0pt'>Compensation to the City will be as follows: The Concessionaire will be required to invest any revenue generated by this concession into the maintenance and/or repair of the Licensed Premises.</span></span></span></p><p><span style='font-size:11pt'><span style='font-family:Calibri,sans-serif'><span style='font-size:12.0pt'><span style='color:black'>Written testimony may be submitted in advance of the hearing electronically to </span>[email protected]<span style='color:black'>. All written testimony can be submitted up until the close of the public hearing and will be distributed to the FCRC after the hearing.</span></span></span></span></p><p><span style='font-size:11pt'><span style='font-family:Calibri,sans-serif'><span style='font-size:12.0pt'>A draft copy of the agreement may be obtained at no cost by any (or all) of the<br>following ways:</span></span></span></p><ol> <li><span style='font-size:12pt'>Submit a written request to DOT at [email protected] from 9/28/2026 through 10/13/2026.</span></li> <li><span style='font-size:12pt'>Submit a written request by mail to Department of Transportation, 55 Water Street, 9<sup>th</sup> Floor, New York, NY 10038. Written requests must be received by 12/1/2025. For mail-in requests, please include your name, return address, and Summerville Enterprises, Inc.
